These Terms of Service ("Terms") govern your access to and use of the eatinero website, digital products, and services (collectively, the "Services"), operated by eatinero, a business registered in the Netherlands. By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our Services.

1. Acceptance of Terms

By purchasing or downloading any of our digital travel guides (the "Products"), you agree to comply with and be bound by these Terms. These Terms apply to all users globally, regardless of location.

2. Description of Services

eatinero provides digitally downloadable travel guides that include:

  • Curated day-by-day plans for destinations.
  • Recommendations for restaurants, activities, hotels, and cultural experiences.
  • Practical tips (transport, budgets, local customs).

Our Products are digital only and delivered as PDF files or other downloadable formats. No physical book or printed copy will be shipped.

Note: Our guides are updated periodically, but we recommend verifying details (e.g., opening hours) closer to your travel dates.

3. Purchases and Payments

3.1 Digital Nature of Products

All Products are digital and non-tangible. Upon purchase, you will receive a download link via email to access your itinerary immediately. No physical products will be shipped.

3.2 Pricing and Payments

  • Prices are listed in Euros (€) and are final.
  • We accept payments via credit/debit cards, PayPal, and other methods provided by Shopify.
  • You are responsible for any taxes, fees, or currency conversion costs applied by your bank or payment provider. Note: If your bank converts Euros (€) to your local currency, the exchange rate and any fees are determined by your bank, not eatinero.

3.3 No Refunds

Due to the digital nature of our Products, all sales are final and non-refundable. Once the Product is downloaded, it cannot be returned or exchanged.

  • Exception: If you encounter a technical issue (e.g., broken download link), contact us at support@eatinero.com within 7 days of purchase, and we will resolve the issue promptly. Technical issues include: broken download links, corrupted files, or errors in delivery. Issues related to your device (e.g., incompatible software) are not covered.

4. Intellectual Property

  • All Products and content on the eatinero website (text, images, logos, designs) are the intellectual property of eatinero and are protected by copyright and other laws.
  • You may use the Products for personal, non-commercial purposes only. Permitted: Printing a copy for your personal trip or saving it on your devices. Prohibited: Sharing the file with friends, uploading it to public forums, or using it for guided tours you sell. You may not:
    • Redistribute, resell, or share the Products with others.
    • Modify or reproduce the Products for any public or commercial use.
    • Use our content without explicit permission.

5. Disclaimers and Liability

5.1 Recommendations Are Not Endorsements

Our Products include recommendations for restaurants, activities, hotels, and services based on our research and local insights. However:

  • We do not endorse, guarantee, or assume responsibility for any third-party services (e.g., restaurants, tours, hotels).
  • You use these recommendations at your own risk. eatinero is not liable for any issues arising from your use of third-party services, including but not limited to:
    • Poor service, food quality, or safety concerns.
    • Cancellations, closures, or changes in operating hours.
    • Personal injuries, losses, or damages.

5.2 No Warranties

Our Products are provided "as is" and "as available". We do not warrant that:

  • The Products will meet your specific needs or expectations.
  • The Products will be error-free or uninterrupted.
  • Recommendations will be available or suitable for your travel dates.

5.3 Limitation of Liability

To the fullest extent permitted by law, eatinero shall not be liable for any indirect, incidental, special, or consequential damages arising from:

  • Your use (or inability to use) the Products.
  • Your reliance on any recommendations or information in the Products.
  • Any third-party services or links included in the Products.

Our total liability to you for any claims related to the Products shall not exceed the amount you paid for the Product in question.

6. User Responsibilities

By using our Services, you agree to:

  • Provide accurate and complete information when purchasing or contacting us.
  • Use the Products only for lawful purposes and in compliance with these Terms.
  • Not attempt to reverse-engineer, hack, or exploit our website or Products.
  • Respect intellectual property rights and not infringe on ours or others’.

7. Prohibited Conduct

You may not:

  • Use the Products for commercial purposes (e.g., reselling or distributing our itineraries).
  • Impersonate any person or entity or misrepresent your affiliation with eatinero.
  • Interfere with our website, servers, or security measures.
  • Harass, threaten, or defame us, our team, or other users.
  • Use automated tools (e.g., bots, scrapers) to extract data or content from our website.

Violating these rules may result in termination of your access to our Services and legal action.

8. Termination

We reserve the right to suspend or terminate your access to our Services at any time, without notice, if you:
